Well, I wouldn't care if it were an option. To each their own.
But I don't see how this would work without breaking focus-follows-mouse. Another window will often get focus as you move the mouse up to the top menu bar and now it will be the window that the menu bar is for and not the one you intended.
Does OSX have focus follows mouse? I remember someone complaining once about not having it. Maybe this is why.
