Agreed, that is annoying behaviour. The best workaround I've found is Logitech's "MouseWare" app. With it installed, using the scroll wheel while the mouse is over an un-focused Window will bring that Window to the front.
Although I stopped using it a while back because it doesn't work very well with KVM switches (switch to another computer and switch back, and the scroll wheel no longer works at all).
