If you actually read the patent, you'd find that's not actually a patent on LLVM at all, it's a patent about a certain method of compiling javascript to a intermediate representation such as LLVM IR or even some other representation, meaning the string "LLVM IR" only appears in the patent at all to serve as an example.

The LLVM bit is really not at all even an interesting part of the patent, the patent is on the method used to convert javascript into an IR of the programmer's choosing - what that IR is is irrelevant.

Edit: Oh, and it is not a patent (at least not yet), it is only a patent application.
