lets hope USA courts will fix these stupid nonsense litigations for good on next cases. Hopefully, on a not so distant horizon, a decision will be reached about patenting "ideas" instead of the original intention, which was about "real" products and "real" process.

deceptive headline from Ars

After all, it isn't as if Google were offering a few billion dollars. The headline makes Oracle sound like some pillar of the community who's temporarily down on his luck. "No, that's OK, I really don't need it, give it to someone who does."

As PJ likes to say, puh-leez. Google offered precisely US$0.00. Not even a penny.

Oracle has no choice but to live with it. Any other move on their part, and they run the risk of getting literally laughed out of court.

What Oracle is saying here is that damages was always a red herring, they are chasing after ongoing infringement that would require Google to buy a license (which will probably be in terms of a cost per device). The maximum damages were always a lot lower than the potential of getting a slice of the Android pie indefinitely, and possibly being able to bring it back into the more Oracle-controlled Java sphere.

And they failed miserably on this first round. Will they stand up and fight again? If good sense prevail about their last combat, may be not, but we are talking about Oracle on which case we never know. Perhaps, they see it like they lost a battle but the war is still going on.

They may try again but the more I see the whole picture the more I doubt they will succeed on any noteworthy aspect.

I think if Oracle plays it cards right, there is very much a chance that Google will have to pay twice the damages.

Unless they'll come up with some new claims - they probably won't get anything. But given that the whole patent / copyright system is rather broken and corrupt, they might find a loophole of course.
