It depends on the area. I know a couple people who lived around me who were arrested for a crime when they had no evidence against them. They were later let go without a trial, as they didn't commit any crimes. The policy here is arrest first, ask questions later. I believe it even happened to a politician here who was falsely accused of illegally obtaining and using prescription drugs when they were prescribed to him... they said they were going to try to switch back to the proper way of trying to gather some evidence before they arrest in the future but who knows if they actually are.
Are you serious? Do you have any idea how the legal system works? Arresting him means the DA probably has enough evidence to convict him. They don't just go arresting people for no reason.
Here in Canada we have a number of people who were convicted of murder and subsequently proved innocent let alone those charged and then found innocent. I Suspect the situation in the US is the same or worse. Especially as some of them are probably now dead after execution.
That he has been arrested is not proof of guilt. The police and public prosecuters often have their own agendas.

Police expressed confidence that the district attorney's office would arraign Reiser on charges for murder even without the discovery of Nina Reiser's body.
So yeah, the probably do have some strong evidence that he did it.
