Novell knew it. And thats why Novell signed a cross-licensing agreement with Microsoft.
Thats why Intel and AMD have cross-licensing agreements.
Cross-licensing agreements are incompatible with the spirit of the GPL. Not to mention that covenants not to sue and other such pseudo-legal rubbish (or even real, legal instruments, come to that) can't be limited to Novell with regards to GPL software they distribute.
At least my "shit-stirring" is based on honesty.

The FOSS fanatics pretty much tried to ignore what Perens said and kept claiming Linux NEVER violated anyones IP. Thats a lie. Perens knows it.

Thats why Intel and AMD have cross-licensing agreements. They both have patents that could derail each others business.
Microsoft has licensed technology from IBM to make the XBOX 360.
Of course IBM is off the hook because they've bribed the FOSS community with a few million lines of code.
Novell is now the junior DEVIL.
