I agree with you about the "reflashed devices" but I don't think that' entirely the point. IN fact when you upgrade your N800 you are reflashing it too.
I think it's more of a liability thing for Nokia, whereas they say they'll do it on a best efforts basis but if they can't make it work for whatever reason then it's up to you.
