Well, technically they're violating PCI requirements if they retain card information or link it with personally identifiable customer data. And I'm not sure that they can actually do anything if they were to track customers daring to exercise their right to use the hardware they purchased as they see fit, but I agree with you that it is a suspect move.
Fortunately, Visa/MC cash cards can work around that problem.
