Getting Mac OS X up and running on a computer without an Apple label has always been a bit of a hassle. You needed customised Mac OS X disks, updates would ruin all your hard work, and there was lots of fiddling with EFI and the likes. Ever since the release of boot-132, this is no longer the case. If Apple were serious about hobbling Hackintoshes, they could do something about that. Add more hardware tests, test the hardware from various places, do it directly, sans EFI. If there were hundreds of binary blobs to be patched (only the kernel is open source), hacks would require a lot of time, Hackintoshes would remain unreliable.
But apparently, they are not so keen about getting rid of Hackintoshes. Isn't this the same as with millions of hacked Windows machines around the world, leading to some sort of world domination?
