Recently, december 2009, the court judged that NetApp has no claims to ZFS. Sun won that case. There is a web page on Sun that details every twist and turn. That case is closed.
NetApp sued Sun in another county, despite that both NetApp and Sun have the head quarters just a few miles a part. NetApp sued Sun in a county used by Patent Trolls. NetApp are nothing more than patent trolls. They are scared shit less about ZFS, which competes with their extremely expensive proprietary WAFL servers. ZFS can offer all that, for free. NetApp are soon doomed.
