The first screenshot shows touch mode enabled but not turned on, the second shows touch mode enabled and on. If touch mode is not enabled then there is no dot at all, such as in the video by The Verge.

Really? When touch mode is on there is a small blue dot in the title bar. There is no such dot in the video by The Verge.
