Earlier this year, the European Commission imposed a massive fine upon Intel for its anti-competitive practices in the OEM space. Intel has been given the opportunity to respond, as is usual in cases like this, and the chip maker is claiming that the fine should be thrown out, because the EC did not prove that Intel's practices hurt the competition.

The French download law has passed the lower house (285 votes to 225). "The law must still be approved by parliament as a whole and the opposition Socialists have already announced they intend to challenge the measure in the constitutional court."

And the Apple vs. Psystar case continues to roll onwards. A lot of mud is going back and forth between the two companies: Apple has accused Psystar of making information public which was under a protective order, and obviously, Psystar denied. In addition, Groklaw's Pamela Jones continues to suspect that this Psystar case is related to the SCO case, and is part of a concentrated effort to destroy the GPL. Update: I've just been emailed (on behalf of Psystar's lawyers, actually) the outcome (in the form of a court order) of the hearing held this morning. Sadly, it's very late here, so I won't be able to analyse it properly until tomorrow.

Microsoft has been granted a stay of a landmark injunction in a patent infringement case that would have required the software giant to stop selling its popular Word in its current form by next month. The U.S. Court of Appeals for the Federal Circuit on Thursday granted Microsoft's motion for a stay, pending appeal, of an injunction issued in August by a federal judge that bars sales of Word that include a custom XML code found to infringe on patents held by i4i - the plaintiff.

The week isn't even over yet, and we already have another instalment in the Apple-Psystar soap opera. Psystar has filed a new lawsuit in the Florida Southern District Court in Miami, asking for an injunction and damages because of Apple's "anticompetitive attempts to tie Mac OS X Snow Leopard to its Macintosh line of computers".

Earlier today we reported that while Apple doesn't encourage it, the Snow Leopard upgrade disk can be used to upgrade machines that have Mac OS 10.4 Tiger installed as well. However, this is actually forbidden by the accompanying EULA, which raises an interesting question: do you have any moral problems ignoring said EULA? And on a more general note, do you actually care about any EULA at all?

Another week, another instalment in the Apple vs. Psystar soap opera. Last week, we left off when Apple was accusing Psystar of destroying evidence, and even though we had a blunt response to El Reg in which the clone maker denied ever having done such a thing, we did not yet have an official court filing from them. Well, we do now.

The legal bickering between Apple and Psystar is almost getting uglier and grittier by the day. In a filing made last week, the Cupertino giant accused Psystar of destroying evidence, but today the clone maker has vigorously denied ever having done such a thing.

We've got some intriguing news about the Apple vs. Psystar case. The depositions where Apple asked questions to Psystar are now over, and now it's time for Psystar to hold depositions of several people in the very highest echelons in Apple. Psystar's new lawyer team takes a more open approach to the lawsuit, and has now published the list of Apple people that will be testifying, and is also asking for community input.

A report by the European Union's ombudsman has now criticised the EC for its conduct, as the EC did not perform proper record keeping, leading to the loss of some evidence. It won't turn the tide for Intel, but it does raise an important question: how fair are these EC antitrust proceedings?

Apple's rejection of the Google Voice iPhone application and the removal of 3rd party clients proved to be the last straw, and now the Federal Communications Commission is involved. The FCC has begun an investigation into the matter. "The Federal Communications Commission has a mission to foster a competitive wireless marketplace, protect and empower consumers, and promote innovation and investment," FCC Chairman Julius Genachowski said, "Recent news reports raise questions about practices in the mobile marketplace."

A win for people who hate the DMCA and censorship. As we reported on earlier this year, Apple pressured the public wiki site Bluwiki into removing several pages about how to sync iPods and other devices with the iTunes database without actually going through iTunes. Apple invoked the DMCA and sent several cease and desist letters, after which Bluwiki removed the pages in question. However, the Electronic Frontier Foundation got involved, and together with law firm Keker & Van Nest they sued Apple. It worked.

It was more or less not a question of if, but when, and now we're here: the US Department of Justice is said to launch an investigation into the US telecommunications industry to see if the two biggest players, AT&T and Verizon, are abusing their market position. Even though Apple is not a target for the probe, the usually trustworthy Wall Street Journal states that the iPhone/AT&T deal will also come under scrutiny .
