Nah, because it's open source it can never *truly* be dead. It seems to pretty actively maintained in the Linux kernel still.
Don't know if this means anything for reiser4, but I'm guessing there's enough momentum behind it to get it into the kernel regardless, and if Hans is removed from the equation it might smooth things out a bit more.
His personal life circumstances seem pretty unfortunate though. We'll see what the legal system does.
