Law and Order Following Microsoft's patent claim against TomTom, the Dutch mobile navigation device maker has countersued Microsoft, claiming the company infringes upon four of its patents. "The GPS device maker, based in The Netherlands, filed the countersuit in the U.S. District Court for the Eastern District of Virginia on Monday. TomTom says Microsoft's Streets and Trips products infringe on four patents it owns related to vehicle navigation software."

The fact that SCO is flat broke hasn't kept them from keeping the legal wars going for years. Investors will be found who are tempted by the prospect of a payout from Microsoft. After all, TomTom has the option of stopping making products and shifting to being a full-time patent trolling company, prying millions out of Microsoft's hide.

This is why patents aren't good for Microsoft as a weapon against smaller companies. If the smaller company has even one patent that Microsoft infringes, the damages they might be able to collect could be worth more than the rest of their business put together.
