A Spanish judge has overturned an injunction Apple won against a Spanish Android tablet maker, N-TK. “A small Spanish company has won a legal case against Apple Inc. and will now be able to sell a tablet computer that the U.S. technology giant had claimed infringes on the iPad patent.” N-TK only sold about 200 of these tablets due to Apple’s legal nonsense, a lot less than their 15000 unit target. As such, NT-TK is going to sue Apple for damages.
Will this serve as a precedent for Samsung to use in Australia?
Samsung are demanding that Apple hand over the iOS source code in the Australian case. I’m sure plenty of IP infringements will be found if this happens.
I really doubt it, since CDs are not legally binding in AU.
If Samsung find any infringements of their own patents they can apply for injunctions in other markets.
Samsung will almost certainly find many patents held by other companies that are being infringed by Apple. Samsung can buy these patents or fund other companies to sue Apple.
I hope they win at least a few millions. Not that it matters too much to Apple but they had losses and they need and deserve it.
Seeing that Android development started 2 years before IOS, I am surprised that no one has shut iPad sales down yet
