Isn't it just a case of counting how many songs you sell, regardless to who, how many others sell and calculating the percentage?
I'd hardly would call this spying. If they didn't collect this information they wouldn't be able to produce any financial data regarding their business which would be a violation of the law.
In any case, the "spy" features of iTunes are all opt-in and can easily be turned off again. I actually often use the Genius option.

How else did Steve in his famous "thoughts on music" know that only 3% of peoples music has been bought on Itunes??
Not to say they aren't gathering anything, but couldn't he have pulled that % out of his rear?
